Layher sues us - again

Only a few months ago Layher AB lost a case against MonZon AB in the Swedish Market court and now they are suing us again. This time Layher claims that we are conducting trademark infringement by using a picture of scaffolding in our catalogue where together with Monzon products a Layher component is included.
- A lot of our customers use Layher gear in their MonZon scaffolds. Since the two brands often are mixed in the same scaffold, a conviction would more or less mean that we would not be able to use photos of our own scaffolds in our marketing material, says Jan Månsson at MonZon AB.

According to a mixing report from SP Technical Research Institute of Sweden it is permitted to use Layher gear in a scaffold assembled with MonZon material. In addition the Swedish Market court in 2007 (MD 2007:1) proclaimed that it is ok to in writing market the possibility to use Layher gear in the MonZon scaffolds. Now it is up to the district court of Gothenburg to decide if the mixing also can be illustrated with a photograph.
